  1. Acceptance of Terms

    By accessing and using the Stalled website (the "Site") and our Software as a Service (SaaS) program (the "Service"), you ("User") agree to comply with and be bound by these Terms of Use ("Terms"). If you do not agree with these Terms, you must not access or use the Site or the Service.

  2. Description of Service

    Stalled provides a consolidated database of casting calls for film projects that are publicly available on various social media platforms. The Service is designed to reduce research time for Users seeking casting calls. We do not create, control, or endorse the casting calls listed in our database.

  3. User Accounts

    To access certain features of the Service, you must create an account. You agree to:

    • Provide accurate, current, and complete information during the registration process.
    • Maintain and promptly update your account information to keep it accurate, current, and complete.
    • Maintain the security of your password and accept all risks of unauthorized access to your account.

  4. Use of the Service

    You agree to use the Service only for lawful purposes and in accordance with these Terms. You are prohibited from:

    • Using the Service in any way that could damage, disable, overburden, or impair the Site.
    • Attempting to gain unauthorized access to any portion of the Site or Service.
    • Using any automated system, including "robots," "spiders," or "offline readers," to access the Site or Service in a manner that sends more request messages to our servers than a human can reasonably produce in the same period by using a conventional web browser.

  5. Content and Intellectual Property Rights

    All content available on the Site and through the Service, including text, graphics, logos, images, and software, is the property of Stalled or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Site and Service for your personal use only.

  6. Disclaimer of Warranties

    The Service and all content on the Site are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

  7. Limitation of Liability

    To the fullest extent permitted by applicable law, Stalled shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

    • Your use of or inability to use the Service.
    • Any unauthorized access to or use of our servers and/or any personal information stored therein.
    • Any interruption or cessation of transmission to or from the Service.
    • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party.
    • Any errors or omissions in any casting calls or for any loss or damage incurred as a result of the use of any casting calls posted, emailed, transmitted, or otherwise made available through the Service.

    The Site and Service may contain links to third-party websites and services that are not owned or controlled by Stalled. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Stalled shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.

  9. Indemnification

    You agree to defend, indemnify, and hold harmless Stalled, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

    • Your use of and access to the Service.
    • Your violation of any term of these Terms.
    • Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
    • Any claim that your content caused damage to a third party.

  10. Termination

    We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms. If you wish to terminate your account, you may simply discontinue using the Service.

  11. Governing Law

    These Terms shall be governed and construed in accordance with the laws of Arizona, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

  12. Changes to These Terms

    We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
